Conditions of use

Common Health Coalition (CHC) (“Common Health Coalition (CHC),” “ourselves,” “we,” “our,” or “us”) operates the website available at commonhealthcoalition.org and other websites where these terms and conditions are posted or made available (the “Sites”), and provides related services (collectively with the Sites, the “Services”). By accessing or using Common Health Coalition (CHC)’s Services, you agree to the following terms and conditions, as well as our Privacy Policy and any other terms and conditions that may appear elsewhere through the Services, all of which are hereby incorporated by reference (collectively, the “Agreement”). As part of such Agreement, the following terms and conditions outline the rules and regulations for the use of Common Health Coalition (CHC)’s Sites and other Services.

This Agreement applies only to the Services identified above. Other sites, apps, social media accounts, or other content Common Health Coalition (CHC) makes available to you may have their own terms and conditions that should be reviewed.

This Agreement is effective as of: July 1, 2025.

IMPORTANT, READ CAREFULLY: THIS AGREEMENT CONSTITUTES A LEGAL CONTRACT BETWEEN YOU AND Common Health Coalition (CHC), GOVERNS YOUR ACCESS TO AND USE OF THE SERVICES, AND CONTAINS IMPORTANT LIMITATIONS ON REPRESENTATIONS, WARRANTIES, CONDITIONS, REMEDIES, AND LIABILITIES THAT ARE APPLICABLE TO THE SERVICES. BY CLICKING ANY BOX OR BUTTON INDICATING YOUR ACCEPTANCE OF THIS AGREEMENT, OR BY OTHERWISE ACCESSING OR USING THIS SITE OR ANY OTHER Common Health Coalition (CHC) SERVICES, YOU REPRESENT AND WARRANT THAT YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, ACCEPT, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT WITHOUT MODIFICATION. IF YOU ARE AN AGENT, REPRESENTATIVE, OR EMPLOYEE OF AN ORGANIZATION OR OTHER ENTITY, YOU FURTHER REPRESENT AND WARRANT THAT: (1) YOU ARE AUTHORIZED TO ACCEPT THIS AGREEMENT ON BEHALF OF SUCH ENTITY AND MAY BIND SUCH ENTITY TO THIS AGREEMENT; AND (2) SUCH ENTITY HAS FULL POWER AND AUTHORITY, CORPORATE OR OTHERWISE, TO ENTER INTO THIS AGREEMENT AND PERFORM ITS OBLIGATIONS HEREUNDER. THE SERVICES ARE NOT AVAILABLE TO PERSONS OR ENTITIES WHO ARE NOT LEGALLY ELIGIBLE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT OR CANNOT AGREE TO BE SO BOUND, YOU ARE NOT AUTHORIZED TO USE THE SERVICES. DO NOT USE THIS SITE OR ANY OTHER Common Health Coalition (CHC) SERVICES IF YOU ARE UNWILLING OR UNABLE TO AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS STATED IN THIS AGREEMENT. YOUR RIGHTS TO USE THE SERVICES ARE FURTHER LIMITED BY APPLICABLE LAWS AND REGULATIONS.

Common Health Coalition (CHC) may provide specialized offerings through the Services that will have additional terms and conditions or rules. If any portion of this Agreement conflict with the special terms or rules for any such special offering, the conflicting portion of the special terms or rules will govern for that specific portion of the offering unless stated otherwise.

Common Health Coalition (CHC) is not responsible for unsolicited content or ideas you may attempt to transmit to us directly. If you do send us unsolicited content or ideas, you agree that we may use such content and ideas in any way we wish without any compensation to you.

In accordance with 47 U.S.C. § 230, parents should be aware that there are parental control protections (such as computer hardware, software, or filtering services) that are commercially available and may assist them in limiting access to material that is harmful to minors. Examples of some of these protection services include Qustodio, Net Nanny, and Kaspersky Safe Kids. Please note that Common Health Coalition (CHC) in no way endorses or is responsible for these services.

Accessibility

Common Health Coalition (CHC) is working to maintain the accessibility and usability of the Sites. It is important to note that our accessibility efforts are ongoing as we work to implement improvements consistent with the Web Content Accessibility Guidelines over time.

For assistance in better understanding the content of this page or any other page on the Sites, please write to us at info@commonhealthcoalition.org and be sure to specify the webpage where you may be having issues relating to assistive technology such as screen readers, so that we can look into making that page more accessible.

Purpose of the Services

The information and content available on the Sites, our social media accounts, and other Services such as email newsletters and any text, graphics, or images are reviewed by health and legal experts, but such information and content are intended to be used for educational, personal, and non-commercial purposes only. The Services and any information or content available through the Services are not intended to provide any medical or health advice, services, treatment, or therapy. Any information or content available through the Services is not a substitute for professional medical advice, diagnosis, or treatment. THE USE OF OR RELIANCE ON ANY INFORMATION OR CONTENT CONTAINED ON OR THROUGH THE SERVICES IS SOLELY AT YOUR OWN RISK.

You agree that you will only use the Services for their intended purposes, and not for any commercial ventures without first seeking approval from Common Health Coalition (CHC). You may not use any content available through the Services to establish any independent data files, databases, compendiums, or any other reference materials.

Any and all content available through the Services are subject to availability. Any and all use of the Services is done at your own risk. Common Health Coalition (CHC) will try its best to make the Services useful, but Common Health Coalition (CHC) does not warrant that any content available through the Services will be accurate or reliable, and does not guarantee that reliance on any information or content available through the Services will be entirely safe or without defect.

License

Common Health Coalition (CHC) hereby grants you a revocable and nonexclusive right and license to use and access the Services (including any underlying software) in a manner that is consistent with the other terms in this Agreement and the Services’ intended purposes. Common Health Coalition (CHC) reserves the right to terminate this license for any or no reason and at any time without notice to you, including, but not limited to, for breach of any term contained in this Agreement.

Intellectual Property Rights and Ownership

Other than the exceptions referenced in this Agreement, the major exception being user generated content which remains the property of the respective user of the Services who uploads or posts such content as set forth in the section titled “User Generated Content,” below, all content appearing through the Services including, but not limited to, graphics, text, documents, data, design, buttons, names, marks, logos, images, video, audio, icons, software and its underlying code, domain names, as well as the color selection, assembly, and arrangement of content, or any other related electronic content or files (collectively “Common Health Coalition (CHC) Content”) are the sole property of Common Health Coalition (CHC) or its licensors, and are protected by U.S. and international copyright, trademark, and other applicable intellectual property laws.

Any use of Common Health Coalition (CHC) Content that is not consistent with the intended purpose of the Services, including any modification, reproduction, republication, uploading, posting, transmission, reverse engineering, creation of derivative works, or distribution in any form or by any means without Common Health Coalition (CHC)'s prior written consent, is strictly prohibited, except you may print out one copy of each page on the Sites solely for personal or internal non-commercial use. Text materials on the Sites may be used, downloaded, reproduced, publicly displayed or reprinted for personal or noncommercial purposes provided that the following attribution appears in all copies: "Reproduced with permission of Common Health Coalition (CHC)." Permission to reproduce text materials for commercial application (e.g., book publishing) must be obtained from Common Health Coalition (CHC) in writing.

No other use of Common Health Coalition (CHC) Content is permitted without Common Health Coalition (CHC)’s prior written consent. You may not sell, transfer, assign, license, or sublicense any Common Health Coalition (CHC) Content. The use or posting of any Common Health Coalition (CHC) Content on any other website or in a networked computer environment for any purpose is expressly prohibited. Unless we have expressly made a file available for download, prior permission to use, download, reproduce, publicly display, or republish any of the non-text materials on the Sites (e.g., software, graphic images, video and audio files) must be obtained from Common Health Coalition (CHC) or any other designated copyright owner, as applicable.

In using any Common Health Coalition (CHC) Content in accordance with this Agreement, you may not (1) state or imply that Common Health Coalition (CHC) is endorsing you, your viewpoints, or any of the products or services that you or your organization may provide, or (2) represent that you or your organization has a relationship with Common Health Coalition (CHC) or any of the events, products, or services that Common Health Coalition (CHC) provides unless that relationship is the subject of a written agreement that has been signed by Common Health Coalition (CHC).

If you violate any part of this Agreement, your right to access and/or use Common Health Coalition (CHC) Content and the Services shall automatically terminate and you shall immediately destroy any copies you have made of Common Health Coalition (CHC) Content. Common Health Coalition (CHC) Content protected by this Agreement includes, without limitation, certain third-party copyrighted images made available on or through the Services. You acknowledge that you have no rights in such third-party Common Health Coalition (CHC) Content. Unauthorized use of any Common Health Coalition (CHC) Content may result in violation of copyright, trademark, and other intellectual property rights or protections available under applicable law. You acknowledge that no right, title, or interest in any Common Health Coalition (CHC) Content is transferred to you as a result of you accessing, downloading, or printing any Common Health Coalition (CHC) Content from the Services. Any use of Common Health Coalition (CHC) Content must display the appropriate copyright, trademark, and other proprietary notices. All software used in connection with the Services is the sole property of Common Health Coalition (CHC) or those supplying or licensing the software.

You acknowledge that you have no right, title, or interest in or to the Services or any Common Health Coalition (CHC) Content.

Any trademarks, graphics, logos, page headers, button icons, scripts, and service names included in or made available through the Services are trademarks or trade dress of Common Health Coalition (CHC), or they may be the property of their respective owners.

There may be other content available through the Services not owned by Common Health Coalition (CHC), and you should respect those property rights as well.

Embeddable Player and Widgets

To the extent that Common Health Coalition (CHC) makes available to you through the Sites (or otherwise) an embeddable player for viewing video and playing audio content from the Sites (the "Embeddable Player") and/or "widgets" to obtain access to content from the Sites ("Widgets"), you agree as a condition to accessing and using such items that:

  • You will not alter or modify any part of the Embeddable Player, the Widgets or any of their related technologies.
  • You will include a prominent link back to the applicable Site(s) on the pages containing the Embeddable Player and/or Widgets, and you may not modify, build upon or block any portion of the Embeddable Player and/or Widgets in any way.
  • You will not use the Embeddable Player and/or Widgets for any commercial use, without the prior written authorization of Common Health Coalition (CHC). Prohibited commercial uses include any of the following actions taken without Common Health Coalition (CHC)'s prior written approval:
    • sale of access to the Sites or any related Services (such as the Embeddable Player and Widgets) on another website; and/or
    • use of the Sites or any related Services (such as the Embeddable Player and Widgets), for the primary purpose of gaining advertising or subscription revenue.

Access Limited

The Services are intended for individuals eighteen (18) years of age or older. If you access or use the Services outside of the United States, you do so at your own risk and acknowledge that such actions do not violate your local laws and regulations. By using the Services, you agree that information about you may be transmitted to and stored in the United States. You are not permitted to violate any laws when using or accessing the Services.

Common Health Coalition (CHC) does not knowingly collect information from children, including those less than thirteen (13) years of age. If you are a child, do not submit any information to Common Health Coalition (CHC). If a parent, guardian, or other concerned person becomes aware that we have collected information from a child, including one less than 13 years of age, please contact us promptly at info@commonhealthcoalition.org and we will take steps to delete and remove any such information.

Some of the Services may require that you create or receive a password and account designation before using the Services. You are responsible for maintaining the confidentiality of any such password and account, and are fully responsible for all activities that occur under your password or account. If you allow third parties to access the Services through your username and password, you will defend and indemnify Common Health Coalition (CHC) and its trustees, employees, agents, affiliates, successors, and assigns from and against any liability, costs, or damages arising out of claims or suits based upon or relating to such access and use. You agree to immediately notify Common Health Coalition (CHC) of any unauthorized use of your password or account or any other breach of security related to the Services of which you are aware.

Cookies

We employ the use of cookies. By accessing the Sites, you agree to Common Health Coalition (CHC)’s use of cookies in accordance with Common Health Coalition (CHC)’s Privacy Policy.

Most interactive websites use cookies to retrieve details about a user’s computer or device, or about an individual’s use of websites for each visit. Cookies are used by our Sites to enable the functionality of certain areas to make it easier for people visiting our Sites.

iFrames

Without prior approval and written permission, you may not create frames around our webpages on the Sites that alter in any way the visual presentation or appearance of our Sites.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to any of our Sites. You agree to immediately remove all links to our Sites upon request.

All rights not expressly granted under this Agreement are reserved to Common Health Coalition (CHC).

Liability Disclaimers

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our Sites and the use of Common Health Coalition (CHC)’s other Services. Nothing in this Agreement will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set forth in this Agreement: (1) are subject to the preceding paragraph; and (2) govern all liabilities arising under any disclaimer in this Agreement, including liabilities arising in contract, in tort, and for breach of statutory duty.

As long as the Sites and related Services are provided free of charge, we will not be liable for any loss or damage of any nature to the extent permitted by applicable law.

The information and reference materials or other Common Health Coalition (CHC) Content contained on the Sites or through our other Services are intended solely for the general information of the reader. Common Health Coalition (CHC) Content is not to be used for treatment purposes, but rather for discussion with the patient’s own physician. The information presented on or through our Services is not intended to diagnose health problems or to take the place of professional medical care. The information contained on or through the Services is neither intended to dictate what constitutes reasonable, appropriate, or best care for any given health issue, nor is it intended to be used as a substitute for the independent judgment of a physician for any given health issue. All content, including text, graphics, images, and information, contained on or available through the Sites or other Services is for general information purposes only. The major limitation of informational resources like our Services is the inability to take into account the unique circumstances that define the health issues of the patient. All visitors to the Sites and users of our other Services agree to read and abide by the complete terms of this Agreement.

To summarize:

  • Common Health Coalition (CHC)’s Services does not constitute an attempt to practice medicine.
  • The use of the Services does not establish a doctor-patient relationship.
  • Individuals should consult a qualified health care provider for medical advice and answers to personal health questions.
  • While the Services try to be as accurate as possible, they should not be relied upon as being comprehensive or error-free.

No Warranties

TO THE EXTENT PERMITTED BY LAW, Common Health Coalition (CHC), ITS AFFILIATES, AND ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, REPRESENTATIVES, ATTORNEYS, TRUSTEES, BUSINESS PARTNERS, CONTRACTORS, AND ANY OTHER PARTY INVOLVED IN THE CREATION, PRODUCTION, OR TRANSMISSION OF THE SERVICES (COLLECTIVELY, THE "Common Health Coalition (CHC) PARTIES") MAKE NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS, OR ENDORSEMENTS ABOUT THE SERVICES OR Common Health Coalition (CHC) CONTENT. THE Common Health Coalition (CHC) PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND RELATED TO Common Health Coalition (CHC) CONTENT INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF APPROPRIATENESS, RELIABILITY, OR TIMELINESS. THE Common Health Coalition (CHC) PARTIES SHALL NOT BE SUBJECT TO LIABILITY FOR THE TRUTH, ACCURACY, OR COMPLETENESS OF Common Health Coalition (CHC) CONTENT OR ANY OTHER INFORMATION CONVEYED TO ANY USER OF THE SERVICES OR FOR ERRORS, MISTAKES, OR OMISSIONS THEREIN OR FOR ANY DELAYS OR INTERRUPTIONS IN THE AVAILABILITY OF THE SITES AND ANY RELATED SERVICES FROM WHATEVER CAUSE. YOU AGREE THAT YOU USE THE SERVICES AND Common Health Coalition (CHC) CONTENT AT YOUR OWN RISK.

THE Common Health Coalition (CHC) PARTIES DO NOT WARRANT THAT THE SITES AND ANY RELATED SERVICES WILL OPERATE ERROR-FREE OR THAT THE SERVICES ARE FREE OF COMPUTER VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. THE Common Health Coalition (CHC) PARTIES DO NOT WARRANT THAT Common Health Coalition (CHC) CONTENT, THE SITES, OR ANY RELATED SERVICES WILL BE UNINTERRUPTED, TIMELY, OR SECURE. IF YOUR USE OF THE SERVICES RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE Common Health Coalition (CHC) PARTIES SHALL NOT BE RESPONSIBLE FOR THOSE COSTS.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, Common Health Coalition (CHC)'s SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE Common Health Coalition (CHC) PARTIES DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, THOSE OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. NO ORAL ADVICE OR WRITTEN INFORMATION PROVIDED BY Common Health Coalition (CHC) OR ITS SERVICES SHALL CREATE A WARRANTY, NOR SHALL MEMBERS OR VISITORS TO THE SITES RELY ON ANY SUCH INFORMATION OR ADVICE.

Limitations and Exclusions of Liability

YOU AND ANY OTHER USER OF THE SERVICES ASSUMES ALL RESPONSIBILITY AND RISK FOR THE USE OF SUCH SERVICES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND IN NO EVENT SHALL ANY OF THE Common Health Coalition (CHC) PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, AND/OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS OR DAMAGES THAT RESULT DIRECTLY OR INDIRECTLY FROM LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR OTHER SIMILAR DAMAGES RELATED TO THE USE OR INABILITY TO USE THE SITES, SERVICES, AND/OR ANY OTHER WEBSITES WHICH ARE LINKED TO THIS SITE, OR THAT RESULT DIRECTLY OR INDIRECTLY FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, VIRUSES, ERRORS, DEFECTS, OR ANY FAILURE OF PERFORMANCE, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ANY SUCH DISCLAIMING PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ANY Common Health Coalition (CHC) PARTY TO ANY USER OF THE SERVICES FOR DIRECT DAMAGES ARISING FROM THIS AGREEMENT OR THE USE OR INABILITY TO USE THE SERVICES WILL NOT EXCEED THE GREATER OF $100.00 USD OR THE AMOUNT THE APPLICABLE USER PAID TO THE Common Health Coalition (CHC) PARTY(IES) FOR THE APPLICABLE SERVICES OUT OF WHICH THE LIABILITY AROSE, REGARDLESS OF THE TYPE OF ACTION WHETHER IN CONTRACT, TORT, OR OTHERWISE.

In states which do not allow some or all of the above limitations of liability, liability shall be limited to the greatest extent allowed by law.

User Generated Content

The Services may allow you to upload or post your own user generated content (“UGC”) in certain locations or as part of your use of the Services. Any UGC you transmit, post or otherwise make available on or through the Services, which includes any comments, images, videos, recordings, ideas, or other information, material, or content you make available in any form including, but not limited to, any visual or audio data, is made available to Common Health Coalition (CHC) on a non-proprietary and non-confidential basis. You hereby grant to Common Health Coalition (CHC) and our designees worldwide, non-exclusive, sublicenseable, assignable, royalty-free, perpetual, and irrevocable rights (including moral rights) and a license to use, reproduce, distribute, modify, adapt, translate, create derivative works based on, publish, perform, and/or display your UGC for the purposes of displaying and demonstrating the capabilities and functioning of the Services, and/or for any other purposes to which you consent, without compensation to you or any other provider of UGC. You also agree to permit any other user of the Services to access, display, view, store, and reproduce such UGC for personal use. This license grant includes any right of publicity rights that may be present in the UGC.

You hereby agree that to the extent you include in your UGC any personal data, personal information or personally identifiable information, as defined under applicable privacy laws and regulations (“Personal Information”), Common Health Coalition (CHC) may process and disclose such Personal Information as necessary to: (1) fulfill Common Health Coalition (CHC)’s obligations under this Agreement; (2) comply with any applicable legal obligations; (3) avoid any imminent harm to you or another person; (4) carry out tasks in the public interest; or (5) pursue other legitimate interests as set forth in this Agreement, provided such legitimate interests are not overridden by the interests or fundamental rights and freedoms of the person whose information is at issue. You agree that you shall at all times use the Services in accordance with all applicable privacy laws and regulations in order to transfer or disclose any Personal Information provided by other users of the Services to Common Health Coalition (CHC) or its affiliates, subcontractors, agents, successors, and/or assigns.

You represent and warrant to Common Health Coalition (CHC) that any UGC you make available on or through the Services is original to you and you own all right, title, and interest, including the intellectual property rights, to such UGC, or you have obtained all permissions, releases, rights, or licenses from the respective owner that are required to grant the rights and assignment granted herein without obtaining any further releases or consents. You further represent and warrant that you will not make any UGC available on or through the Services that infringes third-party rights including, but not limited to, any intellectual property rights, privacy rights, publicity rights, contract rights, or any other rights of any person or entity. You shall be solely liable for any damages, royalties, or fees resulting from any infringement of rights or any other harm resulting from any UGC you make available on or through the Services.

Copyright Violation Notice Procedure

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the internet infringes their rights under U.S. copyright law. If you believe in good faith that materials available on or through the Services infringe your copyright, you (or your agent) may send Common Health Coalition (CHC) a notice requesting that the material be removed, or that access to it be blocked or disabled. Notices and counter-notices must meet the then current statutory requirements imposed by the DMCA (see copyright.gov for details). Notices and counter-notices with respect to the Services should be sent via registered mail to Common Health Coalition (CHC)’s designated agent for notices of copyright infringement claims at:

Under the DMCA, notices must include all of the following details:

  • An electronic or physical signature of the copyright owner or of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work(s) claimed to have been infringed or, if multiple works at a single online location are covered by a single notice, a representative list of such works at such location;
  • A description of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Common Health Coalition (CHC) to locate the material, such as its URL;
  • Information reasonably sufficient to permit Common Health Coalition (CHC) to contact you as the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted;
  • A statement that the complaining party has a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and
  • A statement, made under the penalty of perjury, that the information in the notice is accurate, and that the complaining party is the copyright owner or is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Common Health Coalition (CHC) takes copyright and other intellectual property issues seriously, and will terminate access to the Services for any accounts and/or users that are connected to valid and repeat copyright infringement complaints.

If you believe that any UGC available on or through the Services violates or infringes your intellectual property rights, other than related to copyright, please send a detailed email to info@commonhealthcoalition.org detailing your allegation. Common Health Coalition (CHC) takes infringement of intellectual property rights seriously and will investigate the matter.

Online Conduct and Acceptable Use Policy

You agree to use the Sites only for lawful purposes and acknowledge that you are responsible for your interactions with other users of the Services, and for your other use of our Services. You agree that you will use the Services in compliance with all applicable local, state, national, and international laws. You agree that you are solely responsible for your compliance with all such laws and regulations.

You further agree to act responsibly in relation to other users of the Services. Common Health Coalition (CHC) does not control the UGC posted through the Services and, as such, does not guarantee the accuracy, integrity, quality or availability of such content. Although we do not censor the UGC being posted, we reserve the right to not post, or to remove after its posting, any UGC which in our sole discretion we deem to violate this Agreement or our guidelines. Such UGC may be removed immediately and without prior notice, and further postings by the relevant individual may be blocked.

As a nonprofit corporation, Common Health Coalition (CHC) is prohibited from supporting attempts to influence the outcome of any election for public office or engaging in lobbying activity. Accordingly, these types of UGC are prohibited:

  • UGC that expressly or impliedly endorses or opposes any candidate for public office;
  • UGC that encourages others to contact a government official to express support for, or opposition to, any legislation, including a specific legislative proposal that has not yet been introduced; and
  • Hyperlinks to third-party website pages that contain these types of content, or which direct users to such materials, also are prohibited.

In connection with your access to and/or use of the Services, you agree that you are prohibited from and will NOT:

  • Upload or post on the Sites any unlawful, harmful, threatening, abusive, harassing, defamatory or obscene material of any kind, including, but not limited to, any material that could be interpreted as sexual harassment and/or discrimination or which encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law;
  • Transmit anything that imposes an unreasonable or disproportionately large strain on Common Health Coalition (CHC)’s network or computer infrastructure;
  • Upload or post any inappropriate or offensive content or language, or any UGC that falsely states or otherwise misrepresents your identity or affiliation with Common Health Coalition (CHC) or any person or other entity;
  • Transmit confidential business information or Personal Information in violation of applicable law, or post UGC that infringes any trademark, trade secret, copyright, or other proprietary rights of any party;
  • Submit UGC that promotes any product, service, or material that is harmful to minors;
  • Use any automated technology such as a robot, spider, or scraper to access, scrape, or data mine the Services;
  • Engage in any behavior that attempts to hack into or gain unauthorized access to protected areas of the Services or our computers, servers, or networks, or to any computers or systems used by other users of the Services;
  • Use the Services in a manner that could destroy, damage, or impair any portion of the Services or any computers, systems, hardware, or software used by Common Health Coalition (CHC) or other users of the Services;
  • Make unauthorized attempts to modify any information stored through the Services;
  • Upload or post links to files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
  • Make attempts to defeat or circumvent security features, or to use the Services for any purpose other than their intended purposes;
  • Upload or post any unsolicited or unauthorized advertising or promotional materials, spam emails, chain letters or communications, pyramid schemes, or any other form of such solicitations; and/or
  • Provide fraudulent, false, inaccurate, or misleading information.

The previous list of prohibitions is not exclusive. Common Health Coalition (CHC) reserves the right, in its sole discretion, to restrict, suspend, or terminate this Agreement and/or your access to all or any part of the Services without prior notice or liability in response to your breach of any term in this Agreement.

Although in the absence of a specific complaint any postings you upload or transmit on the Sites or through our other Services are not monitored for compliance with this provision, in an effort to discourage inappropriate conduct, please note that all postings in the comments area will list the author’s name—no anonymous postings are permitted!

You further acknowledge and agree that Common Health Coalition (CHC) may refuse, alter, edit, delete, or disclose anything you post or upload through Common Health Coalition (CHC)’s Services in whole or in part without cause and without notice for any legitimate purpose including, without limitation, to address anything that Common Health Coalition (CHC) determines is inappropriate or disruptive to the Services or to any other user of the Services. Notwithstanding the foregoing, Common Health Coalition (CHC) has no obligation or duty to, and does not represent that it will, monitor, change, or remove any content that you upload or post on or through our Services.

Release

In the event that you have a dispute with one or more other users of the Services, you release the Common Health Coalition (CHC) Parties from any and all claims, demands, and damages (direct and indirect) of every kind and nature, known and unknown, suspected or unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Changes

You understand and agree that Common Health Coalition (CHC), at our sole discretion, may modify or replace the terms of this Agreement at any time without prior notice. You should visit the Sites from time to time to review the current version of this Agreement. If a revision is material we will try to provide at least 30 days' notice prior to the material revision taking effect. What constitutes a material change will be determined at our sole discretion.

In the event of a modification to this Agreement, you will be prompted to accept the Agreement as modified when you next log in to the Services. If you do not accept the terms of the Agreement as so modified, you shall not be permitted to log in to the Services. You may read a current, effective version of this Agreement at any time by selecting the applicable link on the Sites. By using the Sites or any other Common Health Coalition (CHC) Services subsequent to any modification of this Agreement, you agree to be bound by such modification(s).

Common Health Coalition (CHC) has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services including, without limitation, any links displayed on or through such third-party services, nor does Common Health Coalition (CHC) warrant that such third-party services or any information available through such services are current, accurate, or error-free. You access and use any linked third-party services at your own risk. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. The links are not meant to indicate any association with Common Health Coalition (CHC), and Common Health Coalition (CHC) does not endorse any linked site or service, or any goods or services promoted or listed on such sites or through such services. This may include "Like" or "Share" buttons or other interactions through third-party buttons or plugins on the Sites that when used, may allow you to share content from the Sites with other persons on or through the third-party services or elsewhere. If you use any of the social media links or buttons available on or through the Services, Common Health Coalition (CHC) is not responsible for any harm to you as a result of using one of the interaction functions provided by these social media platforms or services.

Indemnification

You agree to defend, indemnify, and hold the Common Health Coalition (CHC) Parties harmless from and against any and all claims, demands, losses, costs, damages, liabilities, judgments, awards, and expenses (including attorneys' fees, costs of defense, and direct, indirect, punitive, special, individual, consequential, or exemplary damages) that any of the Common Health Coalition (CHC) Parties suffer in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party that relates to your use of the Services, your breach of this Agreement, the use of the Services by any person using your computer, device, or account, as applicable, and/or your violation of any applicable law or regulation. Your indemnification obligations shall survive the termination of this Agreement.

Geographic Limitation

The Services are intended only for users within the U.S. If you use the Services outside the U.S., you are responsible for following your applicable local laws and determining, among other things, whether your use of the Services violates any local laws. By using the Services, you agree and acknowledge that information about you, including Personal Information, may be transmitted to, processed in, and stored in the U.S.

Electronic Communications

Governing Law and Dispute Resolution

YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT to submit to the exclusive jurisdiction of the state and federal courts in New York, New York for any litigation arising out of or relating to this Agreement or Common Health Coalition (CHC)'s Services.

YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT to waive any objection to the venue of any such litigation in New York courts.

YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY AGREE not to plead or claim in any New York court that such litigation brought therein has been brought in an inconvenient forum.

The proprietary rights, disclaimer of warranties, representations made by you, indemnities, limitations of liability, and any other relevant language that is meant to remain in effect after this Agreement ends shall survive the termination of this Agreement.

Common Health Coalition (CHC) reserves the right, without notice or reason, to take down or terminate the Services, or to otherwise revoke any and all access granted to you related to the Services. You agree that Common Health Coalition (CHC) is not liable to you or any other third party for this action.

Certain software elements of the Services may be subject to U.S. export laws and controls. No software may be downloaded or exported to any country or foreign citizen that is under a U.S. embargo or that would otherwise violate U.S. law or regulations.

If any term or provision in this Agreement is determined to be invalid, void, or unenforceable for any reason, then the unenforceable provision will be deemed amended in a manner that will most nearly carry out the intent of the provision to the fullest extent permitted by applicable law or deleted if amendment is not possible, and the remaining terms and provisions of this Agreement will be enforceable to the fullest extent permitted by law.

Unless otherwise noted, this Agreement, together with our Privacy Policy and any other terms and conditions that appear elsewhere on or through the Services, constitute the entire Agreement of the parties with respect to the Sites and any related Services and supersede all prior communications, promises and proposals, whether oral, written, or electronic, between you and Common Health Coalition (CHC) with respect to the Sites and any related Services.
